In the October 2019 issue of Ambulatory Surgery Center Association’s ASC Focus, Kimberly Kempton-Serra was quoted in the article entitled “Set
Up a Compliant Patient Transportation Service.”
Ms. Kempton-Serra discusses staying within a new safe harbor and avoiding anti-kickback violations. In order for ASCs to be compliant Ms. Kempton-Serra says “you cannot simply say you provide patient transportation,” “You must document all services delivered and maintain those records.” “This policy should spell out the details regarding the availability of transportation and include an explanation of how the ASC will ensure the policy is uniformly and consistently applied. Failure to do so could put an ASC outside of the OIG’s safe harbor.” She advises “Surgery centers would be wise to consult health care counsel prior to providing transportation to non-patients.”
