Garfunkel Wild won summary judgment dismissal of a multi-million dollar suit filed against Peconic Bay Medical Center based on its filing of a report with the National Practitioner Data Bank that a physician resigned while under investigation. After the First Department Appellate Division upheld dismissal of defamation and other claims, the New York County Supreme Court granted dismissal of plaintiff’s remaining claims for breach of contract, fraud, negligent misrepresentation, promissory estoppel and tortious interference.
