Ms. Koopersmith’s presentation, “Compliance, Residents’ Discharge Rights and Phase 3 Implementation,” will include an overview of:
- New Department of Justice guidelines for prosecutors when evaluating the effectiveness of a corporation’s compliance program in relation to making decisions about bringing criminal charges. The guidelines include several themes that all health care providers should be cognizant of when conducting internal evaluations of their own compliance effectiveness;
- New State regulations on nursing home discharges and what actions nursing homes should take to be in compliance; and
- The last round of items that nursing homes must implement under Phase 3 of the Federal Requirements for Long Term Care Facilities. We will go over recent CMS proposed rules that may change and/or delay some of these requirements.
