On March 8, 2023, the New York Office of the Medicaid Inspector General (“OMIG”) posted materials on its website that provide further guidance on OMIG’s new regulations adopted on December 28, 2022. Specifically, OMIG has provided a Compliance Program Module and a Webinar for providers. OMIG’s new regulations became effective December 28, 2022. Enforcement of the compliance program regulations under Subparts 521-1 and 521-2 will commence on March 28, 2023.
The Compliance Program Module provides a form that lays out the requirements pursuant to Social Services Law Section 363-d and Title 18 NYCRR SubPart 521-1 that providers can reference as a guide to the key components of the new regulations. The Module also advises providers what supplemental documentation they should have with each requirement.
The Compliance Program Requirements 2023 Webinar gives providers a brief twenty minute overview of OMIG’s new regulations and its requirements.
OMIG’s Module and Webinar are useful resources for providers to assist with understanding and implementing the statutory and regulatory requirements. However, providers are urged not to solely rely on the resources provided by OMIG, as they are not all-inclusive.
