New Disclosure Requirement for NY Residential Health Care Facilities

Effective October 1, 2021, residential health care facilities in New York will be required to provide potential residents and their families with a separate document, in no less than twelve point font, as part of their admission packet that includes the following information:

  • how to look up complaints, citations, inspections, enforcement actions, and penalties taken against the facility;
  • the web address for the New York State Nursing Home Profiles website maintained by the New York State Department of Health; and
  • the web address for the Nursing Home Compare website maintained by the U.S. Department of Health and Human Services, if applicable.

This new directive, which amends Public Health Law §2803, was signed into law by Governor Cuomo on August 2nd and follows public hearings held last year by the State Senate.  The directive is geared towards increasing awareness among both residents and families as to the availability of compliance information maintained by the Department of Health with regards to residential health facilities.
