In 2018 the federal Office of Civil Rights (“OCR”) reported an all-time record year for HIPAA enforcement and settlements. Moreover, New York has enacted the Shield Act, which imposes heightened reporting obligations for data breaches. As a result of this heightened enforcement activity and legislation, there are new and evolving strategies for responding to data breaches and government investigations.
