Kathleen (“Kat”) Brown’s practice stretches across a broad range of business, transactional and regulatory issues in the health care space, having developed a particular focus on Medicaid, Medicare, and commercial insurer program compliance, audits and self-disclosures.
Ms. Brown has successfully counseled her clients in the development and implementation of comprehensive compliance programs and effective staff education courses; as well as routinely assisted clients in identifying and navigating potential regulatory pitfalls, including federal and state anti-referral laws, and fee splitting and corporate practice of medicine laws. She has also represented providers in all levels of administrative litigation, including Article 78 appeals, related to New York State Justice Center for the Protection of People with Special Needs matters and Medicaid overpayment audits conducted by the New York State Office of the Medicaid Inspector General; as well as challenged federal contractor audits and statistical sampling extrapolations through CMS administrative appeals.
Ms. Brown’s extensive experience also includes Adult Care Facility (ACF) and Skilled Nursing Facility (SNF) compliance, inspections and enforcement; Non-Profit Corporation entity formation and corporate compliance; and general health care transactions.
Prior to joining Garfunkel Wild, P.C., Ms. Brown developed her health care knowledge through her diverse experiences working in private practice, New York State government, government relations, and health care consulting. From that, Ms. Brown has developed a valuable understanding of the regulatory landscape impacting providers, enabling her to effectively advocate on behalf of her clients before various State and federal agencies in the policy areas of health care, mental and behavioral health, regulatory compliance, human services, and professional licensure.
