Justin M. Vogel, a Partner at Garfunkel Wild, P.C., joined the Firm in 2007. He is a member of the Firm’s Litigation and Arbitration, Appellate Litigation, Employment Law, and Environmental Practice Groups. His practice focuses predominantly on representing business entities, individuals, health care providers, and hospitals in complex business and employment disputes in the areas of: unfair competition and restrictive covenants; secured financing and “factoring” arrangements; commercial and real estate disputes; healthcare reimbursement disputes; defense of claims brought under the Federal Racketeer Influenced and Corrupt Organizations Act (“RICO”); discrimination and retaliation employment claims; landlord/tenant, and warehousing disputes.
Mr. Vogel has substantial commercial trial and arbitration experience, and often appears in New York State and federal courts on matters involving restrictive covenant, exclusive contract, breach of contract, breach of fiduciary duty, partnership break-ups and dissolutions, real estate, discrimination and related employment issues, as well as mental health hearings under the state’s Education Law. He has also argued a number of appeals before the New York Appellate Division.
Prior to joining Garfunkel Wild, PC, Mr. Vogel was an associate in a boutique commercial litigation firm on Long Island with a focus on secured financing and equipment leasing disputes. Mr. Vogel was also an associate in the corporate practice group at Paul Hastings Janofsky & Walker’s Manhattan office.
Mr. Vogel received his B.A. in psychology (cum laude) from the State University of New York at Stony Brook in 1999 where he was elected into Phi Beta Kappa; Psy Chi National Honor Society in Psychology, as well as a number of other prestigious academic organizations. Mr. Vogel also served as the President of Phi Alpha Delta Law Fraternity, International. He received his law degree from St. John’s School of Law in 2002, where he served as the Managing Editor of the American Bankruptcy Institute Law Review and received the Justice Harold Birns Award for the Most Outstanding Published Student Note (which has been frequently cited). Mr. Vogel is admitted to practice law in the United States Court of Appeals for the Second Circuit; the United States District Courts for the Southern, Eastern, Northern, and Western Districts of New York; as well as all New York State Courts. He has been admitted to practice pro hac vice in New Jersey State and Federal Courts. Mr. Vogel is a member of the American Bar Association; the New York State Bar Association; the Nassau County Bar Association; and the American Health Lawyers Association.
