Justin M. Vogel’s practice focuses predominantly on representing business entities, individuals, health care providers, ambulatory surgery centers and hospitals in complex business and employment disputes in the areas of: unfair competition and restrictive covenants; “No-Fault” claim disputes between physicians and carriers; health care reimbursement disputes; defense of physicians, physician practice groups and other health care entities against claims brought under the Federal Racketeer Influenced and Corrupt Organizations Act (“RICO”); secured financing and “factoring” arrangements; commercial and real estate disputes; real estate broker commission disputes;  discrimination and retaliation employment claims; landlord/tenant, and warehousing disputes.

Justin has substantial commercial trial mediation and arbitration experience, and often appears in New York State and federal courts on a wide-range of commercial and health care matters. Justin has also argued a number of appeals before the New York Appellate Division and the United States Court of Appeals, Second Circuit.

Justin prides himself on developing strategies to obtain cost-effective solutions for commercial entities and individuals embroiled in contract and other significant business disputes.

Prior to joining Garfunkel Wild, PC, Justin was an associate in a boutique commercial litigation firm on Long Island with a focus on secured financing and equipment leasing disputes. Justin was also an associate in the corporate practice group of an international law firm.

  • Successfully defended a prominent dermatology practice group against theft of trade secrets, solicitation and restrictive covenant claims brought by a competing practice.
  • Successfully litigated dissolution of a pharmacy entity on behalf of one of its minority shareholders based on alleged misappropriation of corporate assets.
  • Successfully defended a large, academic medical center in Manhattan against a vendor’s breach of contract claims.
  • Successfully represented not-for-profit entity in litigations against several national insurance carriers that resulted in significant changes to pre-authorization requirements for individuals seeking various forms of weight reduction surgeries.
  • Negotiated and brokered complex settlement between two physician practices regarding dissolution of corporate entity and ownership of real estate.
  • Obtained judgment in favor of prominent, high-end real estate brokerage firm against a competing entity seeking a share of substantial commissions on $14,000,000 luxury housing sale.
  • Successful representation of construction firm shareholder and related irrevocable trusts against significant commission claims brought by broker entity arising from $300,000,000 asset sale.
  • Successfully defended large anesthesia practice group and prominent hospital in five-week trial against competing anesthesia group alleging unfair competition.
  • Successfully defended no-fault claim processing company against RICO claims brought by durable medical equipment supplier.
  • Successfully defended chiropractic practice group against RICO claims brought by national insurance carrier.
  • Successfully defended non-profit group caring for individuals with developmental disabilities against breach of contract and unfair competition claims brought by a nursing home operations entity.
  • Successfully defended warehousing / logistics company in $11,000,000 insurance subrogation lawsuit.
  • Successfully defended large physician group against significant breach of contract claims brought by publicly-traded medical supplier.
