Joshua Zarcone joined Garfunkel Wild in 2019. Josh is a member of the firm’s Litigation and Alternative Dispute Resolution Group, which represents clients at all phases of civil litigation in state and federal court, administrative proceedings, arbitrations, and mediations.
Before joining Garfunkel Wild, Josh served as an Assistant District Attorney in Bronx County. As a prosecutor, Josh handled a variety of violent felony cases, including assaults, robberies, burglaries, attempted murders, and firearm possession. Josh prosecuted thousands of misdemeanor and felony cases from intake through final disposition, including conducting dozens of grand jury presentations and trying numerous misdemeanor and felony cases to verdict.
Since joining Garfunkel Wild, Josh has represented clients in various complex commercial litigations, specializing in managed care reimbursement disputes. In addition, Josh has represented clients in employment and civil rights matters, and has counseled clients in connection with regulatory and criminal investigations.
- Represented major New York hospital system in arbitration against managed care payor, resulting in recovery of over $25 million.
- Obtained dismissal of whistleblower/retaliation claim on behalf of large academic health system.
- Represented major New York hospital system in reimbursement dispute with large health insurer, including successful defense against insurer’s appeal.

On April 23, 2024, the Department of Labor (DOL) issued a final rule expanding eligibility for overtime pay (the Rule). This is a federal rule and will set the floor for eligibility for overtime pay nationwide. Individual states may require even higher minimum salary thresholds.
