Colleen M. Tarpey is an experienced litigator who has practiced before numerous state and federal courts, including argument before the Appellate Divisions and the Second Circuit Court of Appeals. Colleen is known as a tenacious and skilled problem-solver, who is committed to achieving her client’s goals while effectively managing their legal costs. In her 20+ years of practice, Colleen has specialized in managed care litigation in state and federal courts and arbitrations, including disputes about provider agreements, claims underpayments and denials, payor recoupments, and out-of-network claims payments, including those involving ERISA plans. Colleen’s skill at managing complex managed care disputes includes significant experience with claims data management and medical coding and billing issues, as well as privacy issues unique to the health care industry, including HIPAA and other state and federal privacy laws. She is an expert in recognizing and assisting her health care clients to defend against the various ways in which managed care companies attempt to avoid payment to providers.
In addition to Colleen’s managed care expertise, she has represented health care and non-health care clients in a wide array of general and commercial litigation matters, including contractual and other disputes, business torts, employment disputes, restrictive covenant disputes, business owner "divorces", and complex multi-party environmental litigations under various state and federal environmental laws.
Additionally, Colleen is a skilled trusts and estates litigator, who has handled contested probate and administration proceedings, contested accountings, kinship hearings, discovery proceedings, cy pres proceedings, and guardianship proceedings.
Colleen has in-depth experience in all stages of litigation, including drafting pleadings, drafting and arguing procedural and dispositive motions, drafting appellate briefs and arguing appeals, taking and defending depositions, serving and responding to written discovery, representing clients in mediations and settlement negotiations, and preparing for and participating in trials and hearings.
