Scott Higgins, a Partner Director in the firm’s Finance and Real Estate and Business practice groups, joined Garfunkel Wild, P.C. in 2002.

Mr. Higgins counsels for-profit and not-for-profit health care entities, including hospitals, nursing homes, continuing care retirement communities, doctors’ groups, and other health care and mental health organizations, as well as privately held companies and financial institutions, on a variety of complex business and lending transactions. Mr. Higgins has extensive experience advising his clients in financing transactions, including tax-exempt and taxable bond financings and refinancings, mortgage, asset-backed and unsecured loans, obligated group financing structures, and capital lease transactions. These transactions include financings through the Dormitory Authority of the State of New York, the New Jersey Health Care Facilities Finance Authority, the Primary Care Development Corporation, and a number of local Capital Resource Corporations and Local Development Corporations throughout New York State, and include credit enhancement from the U.S. Department of Housing and Urban Development, the State of New York Mortgage Agency, as well as private bond insurers and letter-of-credit issuers. He also advises clients on a variety of complex derivative and hedging instruments in connection with these financings.

Mr. Higgins also focuses his practice on representing his clients on a variety of asset or stock purchase and sale transactions, advising on the structure, diligence, negotiation of the terms, and closing of such transactions, and counseling on regulatory and licensing issues that may arise in connection with such transactions.  In connection with his practice, Mr. Higgins has extensive experience in negotiating and drafting a wide array of entity governance documents, commercial contracts, and space lease and licensing agreements.

Prior to joining the firm, Mr. Higgins was an associate in the Mergers & Acquisitions and Securities practice groups at Morgan, Lewis & Bockius LLP and in the Corporate practice group at Fried, Frank, Harris, Shriver and Jacobson LLP.

Mr. Higgins received a Bachelor of Business Administration, with distinction, from the University of Michigan School of Business Administration and a Juris Doctorate from the University of Pennsylvania Law School.

Mr. Higgins is admitted to the bar in the State of New York and the Commonwealth of Pennsylvania.
