Barbara D. Knothe has over 25 years of experience in the health care field. A registered nurse with critical care experience, Barbara has extensive experience in the representation of health care providers, with special emphasis on general health care, regulatory and corporate transactions. Her clients include hospitals, physicians, home health agencies and other health industry providers.
Barbara has particular experience in regulatory issues, including the 340B Program, Office-Based Surgery, EMTALA, Joint Commission, medi-spas, CON, licensure and treatment issues, as well as physician and medical staff issues and health care transactions. Barbara has substantial experience representing health care providers in all types of complex transactions, including mergers and acquisitions, affiliations, joint ventures, and reorganizations. She has been actively involved in the development and implementation of 340B compliance programs for numerous health care facilities and systems. Barbara represents physicians and other licensees in investigations before the Office of Professional Medical Conduct and other disciplinary agencies.
Barbara has been a frequent speaker on 340B, EMTALA, and other federal and state regulatory issues, as well as treatment issues.
Barbara is a contributing author of the “Legal Manual for New York Physicians,” a collaborative effort of the New York State Bar Association and the Medical Society of the State of New York.

In 2020, HRSA waived its requirement that off-site, outpatient hospital facilities be listed as reimbursable on the hospital’s most recently filed Medicare Cost Report, and registered on OPAIS, prior to participating in the 340B program. On October 26, 2023, HRSA released a notice confirming that this waiver has ended.
