General Hospitals and ASCS in 47 Counties Authorized to Start Elective Surgeries

Today, during a press conference, Governor Cuomo announced that 47 New York counties are now permitted to perform elective surgeries in both General Hospitals and Ambulatory Surgery Centers. We are awaiting the formal Executive Order and potential guidance from the New York State Department of Health (“NYDOH”) regarding any steps that ASCs will need take in order to provide these elective surgeries (e.g., case prioritization, patient testing, PPE). Guidance regarding requirements for General Hospitals has already been published by NYDOH. We will continue to keep you updated as we learn additional information.

It should be noted that, according to the Press Release, there are several counties in which ASCs and General Hospitals still cannot yet conduct elective surgeries. These counties include: Erie, the five (5) Boroughs of NYC, Nassau, Suffolk, Rockland and Westchester.
